Terms of Service

These Terms of Service ("Terms") govern your access to and use of the JW Builder website builder and related services (the "Service"), operated by JW Digital Services Ltd("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using it you confirm that you meet these requirements.

2. Your account

You must provide accurate information when registering and keep it up to date. You are responsible for keeping your password secure and for all activity under your account. Notify us promptly of any unauthorised use.

3. Acceptable use

You agree not to:

  • use the Service for any unlawful, fraudulent or harmful purpose;
  • publish content that is illegal, infringing, defamatory, or that violates the rights or privacy of others;
  • attempt to gain unauthorised access to the Service, other accounts, or our systems, or to disrupt or overload them;
  • reverse engineer or resell the Service except as permitted by law.

4. Your content

You retain ownership of the content and sites you create. You grant us a limited licence to host, store, and display that content solely to operate and provide the Service. You are solely responsible for your content and for ensuring you have the rights to use it.

5. Your customers' data

When a visitor sends an enquiry through a site you build with the Service, that enquiry — their name, contact details, and message — is your data, not ours: for it, you are the data controller and we act as your processor under UK data protection law. Our Data Processing Addendum forms part of these Terms and sets out how we process it, including automatic deletion 12 months after receipt. You are responsible for handling enquiries lawfully — including telling your visitors how you use their details and honouring their data protection rights.

6. Plans and billing

The Service offers a free plan and an optional paid "Pro" subscription. Paid subscriptions are billed in advance on a recurring basis through our payment processor, Stripe. By subscribing you authorise us to charge the applicable fees to your payment method until you cancel.

You can cancel at any time from your account settings or the billing portal; cancellation takes effect at the end of the current billing period, and you retain Pro access until then. Except where required by law, fees already paid are non-refundable. We will give reasonable notice of any change to fees.

7. Availability and changes

We may modify, suspend, or discontinue any part of the Service at any time. We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. Features may change as the Service develops.

8. Reported content and takedown

Sites published through the Service are the responsibility of the account that publishes them. If we receive a report that published content is illegal or breaches section 3, we will review it and may unpublish the content or suspend the account while we do — see Report a site for how to notify us and what happens next. Where the law requires us to act on a notice, we will.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us or others. On termination your right to use the Service ends and we may delete your data in accordance with our Privacy Policy.

10. Disclaimers and liability

The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or for fraud). Subject to that, we are not liable for indirect or consequential loss, loss of profits, or loss of data, and our total liability arising from the Service is limited to the greater of the amount you paid us in the 12 months before the claim or £100.

11. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory consumer protections in your country of residence.
